TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale ("Terms") apply to all sales and deliveries of products made through the website vbikestore.it by the seller V Bike Store di Saluppo Giancarlo (the "Supplier"). The Buyer is invited to read these Terms carefully before completing the purchase procedure. By placing an order, the Buyer accepts these Terms unconditionally and agrees to comply with them in their dealings with the Supplier, who is not bound by any other conditions.
1. Definitions

Online Sales Contract: Refers to the contract of sale concerning the movable goods sold by the Supplier to the Buyer through a distance selling system organized by the Supplier.

Buyer: An individual purchasing the goods for personal, non-commercial purposes.

Supplier: The seller, i.e., V Bike Store di Saluppo Giancarlo, who provides the goods subject to the contract.
2. Identification and Obligations of the Parties

Supplier: The goods are sold by the Supplier, whose legal address is C.da Colle delle api 176/H, 86100 Campobasso (CB), registered with the Chamber of Commerce of Campobasso, VAT number 01560350702, email info@vbikestore.it.

Buyer: The Buyer declares that the goods are purchased for personal use and not for commercial purposes and agrees not to resell the purchased products.
3. Object and Conclusion of the Contract

Object of the Contract: The Supplier sells, and the Buyer purchases, the products listed and offered for sale on the website.

Conclusion of the Contract: The contract is concluded exclusively through the website, where the Buyer, following the instructions, formalizes the purchase. The order becomes binding only when the Supplier confirms the order, which occurs through a confirmation email or a printable summary webpage.

Rejection of Orders: The Supplier may refuse an order, for example, in case of errors in the Buyer’s details or if the product is no longer available.
4. Payment Methods and Refunds
Payment must be made in advance via:

Payment details are processed through PayPal or other banks specialized in online payments, using advanced encryption to protect the information.
In case of a refund, the amount will be credited via the payment method used (PayPal or credit card) within 30 days of the refund notification.
5. Delivery Times and Methods
The Supplier commits to shipping products via express courier for deliveries within Italy and Europe, and equivalent methods for the rest of the world. The shipment will occur on the same day as the order, unless the item is immediately unavailable. In case of unavailability, the Buyer will be promptly notified, and a new shipping date will be provided. The order processing time may vary, with a maximum of 3 working days from the order confirmation, unless unforeseen circumstances arise. In case of any shipping delays, the Buyer will be notified via email.
6. Shipping Costs and Delivery

EU Countries: Shipping is made under the DDP (Delivery Duty Paid) method, meaning no additional costs are due by the Buyer.

Other Countries: The DDU (Delivery Duty Unpaid) method applies, and the Buyer is responsible for customs duties and local taxes. It is recommended to check the customs regulations of the destination country.
7. Insurance and Supplier’s Liability
The Supplier is not responsible for theft or damage to the products during transport, but the risk remains with the Supplier until the Buyer or a designated person physically receives the products.
8. Prices
The prices listed on the website include VAT and other applicable taxes for deliveries within the EU. For international shipments, additional costs such as customs duties and taxes may apply, which will be indicated before payment.
9. Product Availability
If a product is unavailable, the Supplier will inform the Buyer via email, providing potential wait times for availability or the option to cancel the order.
10. Limitation of Liability
The Supplier is not liable for damages or service interruptions caused by force majeure events or issues beyond its control, such as internet network malfunctions or courier problems.
11. Liability for Defects and Compensable Damages
The Supplier is not liable for product defects if they were not evident at the time of sale or if they arise from applicable laws. The Buyer is not entitled to compensation if they were aware of the defect or hazard at the time of purchase.
12. Warranty and Assistance Methods
The Supplier is responsible for defects or faults in the products, provided they are reported within 8 days of delivery. Legal warranties of conformity apply to the products, as outlined by the Consumer Code (articles 129-131).
13. Buyer’s Obligations
The Buyer agrees to pay the price due within the specified terms and to retain the order documentation for any future needs.
14. Right of Withdrawal
The Buyer may withdraw from the contract within 14 days from the order without providing reasons, in accordance with the provisions of Legislative Decree no. 206 of 6 September 2005 (and subsequent amendments and additions) provided the goods are returned in their original condition. In the case of returns, shipping costs are borne by the Buyer.
A refund will be processed within 14 days of receiving the returned product.
15. Contract Archiving Methods
Each order is stored in digital format on the Supplier’s server, in compliance with privacy and security regulations.
16. Communications and Complaints
For communications or complaints, the Buyer can contact the Supplier via email at info@vbikestore.it or send a registered letter to the legal address.
17. Dispute Resolution and Applicable Law
In the event of any disputes, the competent court is the one in the Supplier’s place of residence or domicile. This contract is governed by Italian law.
18. Duration and Modifications of the Contractual Terms
The contractual terms are valid from the moment the Buyer confirms the order. Any changes to the Terms will apply only to orders that have not yet been sent.
